1. Abra Portal for Housing Associations
These terms of use describe the rights and obligations you have as a user of the https://portal.abralife.com/ («Abra Portal for Housing Associations»). The terms of use are in addition to the terms for each subscription, product or service.
Fell Technology AS (from now on referred to as "we" or "us" in this document) supplies the Abra Portal for Housing Associations (from now on referred to as the "Portal" in this document) and is your contracting party in connection with the use of the Portal and the purchase of available products, subscriptions and services.
The Portal is only available for individuals representing their housing association. The residents of the housing association can not create their own user accounts in the Portal. The residents can create user accounts in the Abralife mobile application ("Abralife app") and get information and access to products and services they have access to via the housing association. Separate user terms for the Abralife app is available here.
2. User account
Any housing association who have signed an agreement for purchasing our services, may create a user account in the Portal. A representative from the housing association must create the account on behalf of the housing association.
When creating a user account, the representative of the housing association must provide his or her name, mobile number and information about which housing association the representative acts on behalf of, as well as the position he or she holds in the housing association. To create a user account, the representative must accept these terms of use. If necessary, we can demand documentation that the person creating the user account is authorized to act on behalf of the housing association.
The representative can terminate the housing association's user account in the Abra Portal, by going to "My user" and selecting "Delete user". The user account will then be deleted immediately. Deleting a user account does not mean that the housing association's subscriptions are terminated. The conditions for termination of subscriptions are regulated in the subscription terms.
The Abra Portal gives the housing association's representative access to obtain information about which installations have been carried out in the housing association's housing units. The representative will also have access to information about whether the products installed in each household are (i) connected, and (ii) issue any error messages or notifications.
3. Intellectual property rights
All content in the Abra Portal, apart from the users' personal data, is owned by us and is protected by intellectual property rights. There is no transfer of rights from us to the housing association when using the Abra Portal or associated services.
4. Privacy
In order to manage the housing association's user account, we must process information about the housing association's representative, as well as the households in the housing association that receive our services. See our privacy policy for more information on how we process personal data.
5. Changes
We reserve the right to make changes to the Abra Portal, i.a. to meet new needs and further develop our services. This may be changes to the terms of use, the terms of sale, or the privacy policy, as well as the content of our products, subscriptions and services.
If the changes require obtaining new consent, the housing association's representative will be asked to do so before the changes become available.
6. Transfer of rights
We reserve the right to fully or partially transfer our rights and/or obligations in connection with the delivery of Abra Portal to another company.
7. Responsibility
We are responsible for all information and data being correct, provided that users have provided correct personal information. However, terms are subject to misprints, technical failures, outages and similar unforeseen events.
8. Misuse
We reserves the right to change or delete the housing associations user account, change the content and/or deny the housing association's representative access to the Abra Portal if there are factual reasons for this. This applies in particular if we have reason to believe that there has been a breach of the subscription terms.
Before we possibly make changes or delete a user account, access to the relevant user account will be temporarily blocked. If the user account is deleted due to misuse, the relevant representative may be refused to create a new user account. In such cases, the housing association will be able to create a new user account by appointing a new representative.
9. Disputes
These terms of use are governed by Norwegian law. Any disputes related to the terms of use, and which the parties do not resolve in dialogue, shall be settled by Norwegian courts.
